Article 2) Subject

This agreement is executed to set forth mutual rights and obligations of the Consumer who ordered the product identified here below on the website Midasb2b.com and the Seller who owns said website pursuant to Law No. 4077 on Protection of Consumers, as amended by Law No. 4822, and Regulations on Distant Agreements Applications Rules and Principles.

Article 5) General Terms and Conditions

Those under 18 years old cannot do shopping on Midasb2b.com. By electronic confirmation of this agreement, the Consumer confirms that he/she is older than 18 years old.

The Seller assumes no responsibility for any price and content mistakes which may result from typesetting and system errors. The Seller reserves its right to cancel any orders with the wrong price.

By confirming this agreement electronically, the Consumer shall be deemed to have confirmed that he/she accurately and completely received all address and phone details, as well as basic features of ordered products, price of products including taxes, payment and delivery details which the Seller is required to provide to the Consumer prior to the execution of the distant agreement.

If the product price is not paid or revoked in bank records for any reason whatsoever, the Seller shall be deemed to have been released from the obligation of delivering the product.

In orders payable by remittance/EFT, the Seller shall not put into the process on order placing date but the date when the Seller acknowledges receipt of the payment in its account. The Consumer shall agree and accept that the Seller will cancel any orders placed by the Consumer payable by remittance/EFT if the Consumer fails to make relevant payment in 1 week.

In cases where the payment is made using credit card or a similar payment card, if the bank or financial organization refuses to make payment to the Seller for the product price as a result of unlawful and wrongful use of Consumer’s credit card by unauthorized people after delivery of the product without the consent of the Consumer, the product must be returned to the Seller within 3 days if the product has been actually delivered to the Consumer himself/herself.

Article 6) Seller’s Obligations

The Seller shall fulfil the order in no later than thirty days after receipt of the Consumer’s order. Said time period can be extended ten days maximum to the extent that the consumer has been given prior notice in writing.

The Seller shall not be held responsible for any failure in the delivery of products ordered to the Consumer due to any problems which might be confronted by the courier during in the course of product’s delivery to the Consumer.

The Seller shall not be held responsible if and when the buyer in the delivery address does not accept the delivery of the ordered product.

The Seller can offer and provide the Consumer with a product of equal quality and price before the performance deadline to such an extent that it is based on a just cause.

For some reasons, the production of any ordered products may not be possible. If the Seller fails to perform its obligations hereunder due to impossibility of fulfilling the ordered goods or services, the Consumer shall be notified thereof prior to expiration of the deadline for performance obligation under the agreement. The Seller shall return the fee paid and any obligatory documents to the Consumer within 10 days.

As the products ordered involve hand-workmanship production by the Seller, there can be a +/-10% difference in carats and gram weights of products. The adjustment of ring sizes according to the ring size to be designated by the Buyer can also cause a difference in gram weight of gold.

The Consumer shall be entitled to withdraw from the agreement within seven days upon delivery of the ordered product to the Consumer or the person/entity in the address designated as the Delivery Address by the Consumer. In order to exercise the right of withdrawal, the Seller must be notified thereof through the communication form, e-mail or phone designated on the website Midasb2b.com, and that the relevant product should not be a product covered under ‘Article-7 Products with No Right of Withdrawal’. The Seller shall have the right to refuse any returns made without prior notice to the Seller.

When returning the product, the Consumer or the third person must return the product to the Seller completely with its invoice, delivery note, certificate, insurance forms, product box, packaging and other documents and materials delivered to him/her. In case of products which are returned without an original invoice, the VAT and other legal charges, if any, will not be refunded. The Consumer shall be responsible for any deformation, damage or similar depreciatory events occurring during the return on the product or any documents and materials accompanying the product attributable to the courier or the Consumers who returns.

The product price shall be refunded to the Consumer within 7 days after receipt of these documents.

Article 7) Products with No Right of Withdrawal

For customized goods which are produced or modified or supplemented according to special demands and requests of the Consumer, the Consumer shall not be entitled to exercise his/her right of withdrawal. Therefore, any products which bear engravings as per the request of the Consumer, and any products produced as per demands of the Consumer shall be considered as products for which no right of withdrawal can be exercised.

Article 8) Competent Courts

For values up to the limit as stipulated by the Ministry of Industry and Trade, the Consumer Arbitration Committees, and the Consumer Courts in the residence place of the Consumer or Seller shall have jurisdiction over the execution of this agreement.

The Consumer shall be deemed to have accepted all terms and conditions of this agreement upon fulfilment of the order.
